How do I reschedule my court date in Oregon? ›

I need to reschedule my Court date. Under most circ*mstances, the Court can grant one extension of your original arraignment date for up to seven days. Please call the Clerk's Office at 419-698-7010 prior to your scheduled hearing to request a continuance.

Oregon's state court system includes county circuit courts, along with the Supreme Court, Court of Appeals, and Tax Court.

In Oregon, the judiciary has four general levels. The County Courts, Justice Courts, Municipal Courts, and Tax Courts are the lowest level courts, focusing on cases involving specific subject matter, such as traffic violations, small claims, and misdemeanor offenses.

You may not change your appearance date by leaving a message, email or voice mail. If you fail to appear as scheduled, a warrant may be issued for your arrest, and other sanctions may be imposed. If the charge is a violation or the case is a civil matter, the court may decide the case in your absence.

Your continuance letter should explain your reasons and justification for the postponement. Start by briefly stating the reasons that led to your request. This should be followed by a more detailed explanation that provides evidence to support your claim.

Summons shall be served, either within or without this state, in any manner reasonably calculated, under all the circ*mstances, to apprise the defendant of the existence and pendency of the action and to afford a reasonable opportunity to appear and defend.

The Oregon rule requires a response within 30 days of service of a request, except that a defendant cannot be required to respond earlier than 45 days after service of summons unless the court specifies a shorter term.

A district court is considered always open for any filing, and for issuing and returning process, making a motion, or entering an order. (b) Office Hours. Can I reschedule/continue my court date? If you need to reschedule your court date and it is before your scheduled appearance, you need to contact the officer at 864-271-5333. You may have to leave a message. You may also request a continuance in open court, however, you will need a valid reason to do so.

You must first call the other party and try to agree to change the date. If both parties agree on a new date, a praecipe (an official form used to request the clerk or court to perform an act) to continue the case must be filed in the Small Claims Clerk's Office.

If you would like to reschedule a court hearing because you are unable to appear, you must file a written request for a continuance with the court 5 days in advance. You must also send a copy of your written request to the other party. A judge will review your request.
